Terms of Use

1. Agreement

These terms govern your use of fritzsearch.com ("Fritz Search", the "Service"), operated by Marc Swikull, an individual doing business as "Fritz Search" ("we", "us"). By using the Service you accept these terms. If you create an account, you accept them expressly at registration. If you do not agree, please do not use the Service.

2. The Service

Fritz Search is a free, informational search engine over books, authors, and book endorsements, compiled from publicly available sources — chiefly publisher materials. We do not sell products on this site. We may display advertising, including ads from authors, publishers, or their representatives for their books. Advertising is always clearly labeled as advertising and kept separate from search results and book and endorsement information. No one can pay to change which books or endorsements appear in results, how results are ranked, or what an endorsement says. Some links to retailers are affiliate links: when you buy a book through a Bookshop.org link on Fritz Search, Bookshop.org pays us a commission. Commissions and advertising never affect which books or endorsements we show or how search results are ranked.

3. Eligibility

You may browse Fritz Search without an account. To create an account or use the contact form you must be at least 13 years old. If we learn that an account belongs to a child under 13, we will close it (see our privacy policy on children's information).

4. Accounts

You do not need an account to use Fritz Search. If you create one, you agree to: provide a working email address that is yours; keep your password secure (you are responsible for activity under your account); and maintain at most one account for yourself. We may suspend or delete accounts that violate these terms, and you may delete your own account at any time from your account page.

5. Acceptable use

You agree not to:

  • use the Service for anything unlawful, or to harass, defame, or harm anyone — including the real people whose profiles appear here;
  • interfere with the Service's operation, probe or breach its security, or access data not intended for you (including other users' accounts);
  • crawl, scrape, or bulk-download the Service at volumes that degrade it for others, or circumvent rate limits or technical protections;
  • run automated tools against the Service except in accordance with our robots.txt file and any published technical limits (ordinary search-engine indexing and personal, low-volume use are welcome);
  • misrepresent Fritz Search as endorsing you or your work, or impersonate us or anyone else through the Service (including through the contact form).

6. Content and accuracy

The book, author, and endorsement information on Fritz Search is compiled by automated means from public publisher and retailer sources. We work to keep it accurate and current, but we cannot guarantee it: publisher pages change, and automated collection makes mistakes. The Service is provided for general information — verify anything important against the publisher's own materials.

If information about you or your work is wrong, tell us via the contact form (topic: data correction) and we will review and fix confirmed errors. The privacy policy describes the removal and objection rights of people who appear on the site.

Endorsement texts, book descriptions, and cover images remain the property of their respective rights holders; they are reproduced here from publicly published materials for identification and discovery. Rights holders with concerns can reach us via the contact form.

Fritz Search reproduces book information, endorsement texts, and cover images from publicly published sources for identification and discovery. We respect the rights of their owners. If you believe material on the Service infringes your copyright, send us a notice via the contact form (topic: legal or other concern), including: (1) identification of the copyrighted work; (2) the URL(s) on our site where the material appears; (3) your name and contact information; (4) a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; (5) a statement, under penalty of perjury, that the notice is accurate and that you are the copyright owner or authorized to act for the owner; and (6) your physical or electronic signature. We will review complying notices promptly and remove or disable access to material we determine to be infringing. We may terminate the access of repeat infringers.

8. Our content; what we do not claim

The Fritz Search name and logo, the site's design and software, and the original text we write are ours. We claim database-compilation rights only to the extent the law provides them; we claim no ownership of the facts we compile, and none of the endorsement texts, book descriptions, or cover images — those remain the property of their respective rights holders (see "Content and accuracy").

You may link to any page, and personal, non-commercial use of the Service is welcome. As a term of using the Service, you agree not to systematically copy, extract, or republish substantial portions of the Service's database without our written permission — this is a contractual condition of access, and it does not restrict anything you obtain independently of the Service.

9. Feedback and corrections

If you send us corrections, suggestions, or other feedback, you give us a non-exclusive, royalty-free permission to use them to operate and improve the Service. You keep any rights you have in what you send; nothing in this section limits your right to review or comment on Fritz Search anywhere you choose.

The Service links to external sites (publisher and retailer pages). We are not responsible for their content or their privacy practices. Some retailer links are affiliate links, as described in section 2.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

Some jurisdictions do not allow certain warranty disclaimers; in those places we disclaim only to the extent the law allows.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, GOODWILL, OR PROFITS, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE — WHICH IS FREE — WILL NOT EXCEED ONE HUNDRED US DOLLARS (US$100).

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited — including liability for fraud or willful misconduct and, for consumers in the United Kingdom or European Union, liability for death or personal injury caused by negligence.

13. Indemnification

If your violation of these terms, or your unlawful use of the Service, causes a third party to bring a claim against us, you agree to indemnify us — that is, to cover our reasonable losses, damages, and legal costs from that claim. This section does not apply to ordinary use of the Service in compliance with these terms, and does not limit any rights you have under the consumer-protection laws of your place of residence.

14. Suspension, termination, and changes to the Service

We may suspend or terminate access to the Service (or any account) for breach of these terms or to protect the Service and its users; where practical, we will say why. You may delete your account at any time from your account page. We may change, limit, or discontinue the Service (or any feature) at any time; if we discontinue the Service entirely, we will make reasonable efforts to give advance notice on the site. Any section that by its nature should survive termination — including content and accuracy, our content, disclaimers, limitation of liability, indemnification, and governing law — survives.

15. Governing law and disputes

These terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules. If you have a dispute with us, contact us first via the contact form — most issues (especially data corrections) are fixable without formality, and we ask for 30 days to try. Any claim that cannot be resolved informally must be brought in the state or federal courts located in Monterey County, California, and both sides consent to those courts' jurisdiction. If you are a consumer in a jurisdiction whose law gives you the right to sue at home, this section does not take that right away.

16. Changes to these terms

We may update these terms as the Service, our practices, or the law change. Each version has an effective date, and past versions remain available in our public archive at fritzsearch.com/terms/versions. If a change is material, we will give advance notice — at least 30 days before the new version takes effect — by posting a notice on the site and, for account holders, by email to your registered address. Non-material changes (like clarifications or typo fixes) take effect when posted. Changes are not retroactive: a dispute is governed by the version of these terms in effect when the events giving rise to it occurred. If you do not agree to an updated version, stop using the Service (and delete your account, if you have one) before it takes effect.

17. General terms

If any part of these terms is found unenforceable, the rest remains in effect. These terms and the privacy policy are the entire agreement between you and us about the Service. You may not assign your rights under these terms; we may assign ours to a successor that operates the Service (for example, a company formed to run Fritz Search). If we don't enforce a provision, that is not a waiver of our right to enforce it later.
